Mediation
We mediate government contract disputes, construction claims, commercial conflicts, and regulatory matters involving federal agencies, prime contractors, subcontractors, and sureties. These complex, often multimillion-dollar cases involve claims for additional work, design changes, unforeseen conditions, delay or disruption damages, and contract performance disputes.
Mediation is a confidential, collaborative process. We combine facilitative and evaluative techniques, tailoring our approach to each dispute. We conduct pre-session discussions, review written submissions, and may begin with a joint session to define issues, followed by private caucuses to explore solutions. When negotiations stall, we employ bracketing, mediator's proposals, neutral evaluations, or expert input. Most cases result in final, binding settlements.
Arbitration
We serve as neutral arbitrator on American Arbitration Association panels for Construction, Commercial, Government Contracts, and Healthcare matters. We have presided over multiple arbitrations involving disputes exceeding $10 million, serving as sole arbitrator, party-appointed arbitrator, and panel chair.
We manage complex, document-intensive proceedings, including prehearing conferences, scheduling orders, dispositive motion practice, expert witness management, and e-discovery disputes. We conduct full evidentiary hearings both in-person and virtually, issue reasoned and standard written awards, and are well-versed in AAA Commercial, Construction, and Government Contracts Rules and Procedures.
Expert Consulting
We provide expert consulting services on government contract performance issues, construction claims analysis, Contract Disputes Act procedures, and federal procurement regulatory matters. Our consulting work supports law firms, contractors, and agencies in case strategy, technical legal analysis, and dispute preparation.
